Terms and Conditions of Kinder Hop Partner Program

 

The following Terms and Conditions contain a set of rules applicable to all Partner Program Members.

In order to obtain benefits resulting from the cooperation with Kinder Hop, the Partners are required to accept and act in compliance with the Terms and Conditions.

 

§ 1 Definitions

        Partner Program - the entire program can be found a thttps://kinderhop.com/en/content/25-terms-and-conditions-partner-program

        Products - all products available at www.kinderhop.com.

        Partner - a natural or legal person participating in the Partner Program.

        New Customer - a customer who has registered via personalized affiliate link), ordered one of the products, and made a payment.

        Partner Agreement - an agreement concerning participation in the Partner Program concluded between the Partner and Kinder Hop.

        Minimum Amount - the amount that allows the Partner to request a commission payment.

        Affiliate Link - a link to www.kinderhop.com, containing Partner ID.

 

§ 2 General Conditions

1. Partners shall be natural persons, persons engaged in economic activity, or legal persons who shall accept the Agreement and the aforementioned Terms and Conditions of the Partner Program.

2. A candidate for a Partner who is a natural person may conclude an agreement under the terms specified below provided that he is able to issue a sales invoice to Kinder Hop to settle the commission due to him.

3. Participation in the Partner Program is free and voluntary.

4. The Partner shall not be an employee or representative of Kinder Hop. The Partner has no right to sign any documents on behalf of Kinder Hop nor represent himself or his business on behalf of this company. The Partner shall only be entitled to introduce himself as a member of the Partner Program or publish affiliate links, which automatically charge a commission on orders placed and paid for through them.

5. New customers do not constitute a group of existing Kinder Hop users.

6. The cooperation within the program is concluded for an indefinite period of time and can be terminated by either party.

 

 

 

 

§ 3 Customer Referrals and Partner identification

1. Each Partner shall receive a unique Partner ID.

2. Partner shall gain New Customers through Affiliate Links - hyperlinks leading to Kinder Hop commands containing Partner ID or dedicated discount codes.

 

§ 4 Remuneration for the Partner

1. Partners shall only be rewarded for the purchase of products by their referred New Customers via the Affiliate Link or the discount code entered during order placement.

2. The amount of remuneration for Partners shall be 10% of the value of each order made by a New Customer.

3. The remuneration shall be calculated at the moment of charging the New Customer.

4. The Partner shall be entitled to commissions valid on the day of the transaction.

5. The Partner shall not be remunerated for referring and acquiring new Partners for the Partner Program. Registration in the Partner Program is free and voluntary.

6. The Partner's account balance containing the sum of due commissions is located in the Partner Program Client Panel.

7. The commissions are paid to the Partner once they reach the minimum amount of €20. The payment is made on the basis of the sales invoice sent by the Partner.

8. In order to pay out the Commission, the Partner who is a natural person not engaged in business activity may issue an invoice to Kinder Hop, and if he/she is not engaged in business activity, it is possible to use dedicated services such as:

A partner who is a natural person conducting a business activity or a legal person shall issue an appropriate invoice.

 § 5. Kinder Hop Promotion Methods

1 The Partner shall be responsible for all content that appears on his/her pages or in his/her promotional materials. Kinder Hop shall not be responsible for any content related to its products published outside the company website.

2. If the Partner publishes the product prices in his/her content, he/she is obliged to keep them up to date with the current price list at www.kinderhop.com.

3. The Partner is obliged to know the legal regulations concerning advertising and providing e-services.

 4. The Partner shall not promote Kinder Hop on sites that violate the law, contain pornographic material, illegal software, illegal music or other sites that may damage the company image with their content or form.

 5. The Partner is obligated to formulate all communication concerning the offer of Kinder Hop presented within the Partner Program (in particular, mailings, content on the Partner's website used for activities within the Partner Program, the content of e-mail correspondence sent as part of Partner's activities within the Partner Program) in a way that makes it clear that the content of such communication comes from the Partner, not directly from Kinder Hop.

 

§ 6 Security of Partner's and Customer's Data

1. Any changes to the Partner's personal data and bank account shall be made by the Partner.

2. Change of data shall not be misleading or aiming at the change of the Partner.

3. Current data concerning the Partner and his account balance displayed on the Partner Program Fixed Income tabs shall be truthful. Kinder Hop does not have to verify the data correctness.

4. Kinder Hop's technical department shall make every effort to secure the consistency and content of databases.

5. The Partner agrees to send him/her amendments to the Terms and Conditions and other useful information related to the Partner Program. If the Partner does not wish to receive such notifications, he/she shall submit such a request in writing. 

6. Publishing and distributing information sent to the Partner and available in the Partner Program Panel is not allowed.

 

§ 7 Representation

1. The Partner shall carefully promote the Kinder Hop brand in accordance with the intended use of the tool, taking into particular consideration the current status of the information presented by him/her.

2. The Partner shall not promise any potential or New Customer products other than those available at www.kinderhop.com.

§ 8 Deactivation of Partner's Account

1. Failure to comply with the rules of the above Terms and Conditions shall result in account deactivation.

2. Taking by the Partner any actions considered by Kinder Hop as harmful to the sales results and its image may be the basis for immediate deletion of the account and termination of the contract with the Partner.

3. Launching a competitive activity against Kinder Hop by the Partner results in immediate termination of the agreement between the parties and deletion of the Partner's account without saving the commissions accrued.

4. The deactivated account shall not be affected by any new funds. The funds collected so far cannot be withdrawn.

5. The Partner can terminate the cooperation in the Partner Program by sending a written request to Kinder Hop in order to deactivate the account. Otherwise, the Partner account remains valid until deactivated by Kinder Hop.

6. Deactivation of an account in the Partner Program and the Partner's commitments shall not hinder the possibility of resuming cooperation in the future.

7. The Partner shall have the right to apply to Kinder Hop for account re-activation.

 

 

§ 9 Amendments to the Terms and Conditions.

1. The applicable Terms and Conditions of the Partner Program including the current changes are published on https://kinderhop.com/en/content/25-terms-and-conditions-partner-program

2. The Kinder Hop team shall notify the Partners by e-mail to the e-mail address indicated by the Partners in the Registration Form about changes in the Terms and Provisions and changes in the Commission.

3. The Partner agrees to receive information concerning the Partner Program from Kinder Hop to the e-mail address provided in the Registration Form.

4. In matters not regulated in these Terms and Provisions, the provisions of generally applicable law shall apply.
